Pedersen Law secured a Virginia Court of Appeals win in a military retirement case, reinforcing the importance of precise divorce settlement agreements.
Pedersen Law, PLLC recently secured a favorable ruling from the Court of Appeals of Virginia in Pollock v. Pollock, a divorce appeal involving military retirement benefits.
On March 3, 2026, the Court of Appeals reversed a Rockingham County Circuit Court order that had added new terms to the parties’ Property Settlement Agreement. Pedersen Law represented the husband and argued that the trial court improperly inserted an indemnification provision and replaced the agreement’s use of “gross pay” with “disposable retired pay.”
The Court of Appeals agreed. It held that property settlement agreements must be enforced as written and that courts cannot add terms the parties never accepted.
The military retired pay division order was vacated, and the case was remanded for further proceedings consistent with the appellate decision.
The ruling is a significant appellate win for Pedersen Law and reinforces the importance of precise drafting in Virginia divorce cases involving military retirement.
